1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Hodler Store website, our clothing products and our AI-powered fashion features ("Hodler AI"), all operated by Hodler LLC, 28218 226th Pl SE, Maple Valley, WA 98038 ("Hodler", "we", "us" or "our"). By accessing or using our website or services, you agree to these Terms and to our Policies. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place orders or create a Hodler AI profile. Users between 13 and 18 may use the website only with the involvement and consent of a parent or legal guardian.

3. Products & Information

• We make every effort to display our products, colors and details accurately. However, colors may appear differently depending on your screen, and slight variations in fabric and finish can occur.
• Product images on this website may include styling inspiration and may show accessories or pieces that are not part of the item described.
• All products are subject to availability. We reserve the right to modify or discontinue any product without notice.
• Size guides and AI fit recommendations are provided as guidance and do not guarantee a perfect fit.

4. Inquiries & Orders

• Product inquiries and orders can be placed by contacting us through the website or by email. An order is confirmed only when we send you a written confirmation.
• We reserve the right to refuse or cancel any order, for example in cases of suspected fraud, errors in product information or limited stock. If an order is cancelled after payment, you will receive a full refund.
• Shipping, returns and exchanges are governed by our Shipping and Returns & Exchanges policies.

5. Hodler AI Services

Hodler AI includes virtual try-on, AI design tools, 3D garment visualization, size prediction, AR/VR experiences and AI styling suggestions. By using these features, you understand and agree that:

• AI-generated images and previews are simulations intended to help you visualize clothing. They may not perfectly reflect real-world fit, color, texture or drape.
• Size and style recommendations are informational and are not guarantees.
• Features may be offered in preview or beta form, and may change, be suspended or be discontinued at any time.
• You will only upload photos of yourself, or of people who have given you permission to do so.
• You will not use Hodler AI to create misleading, offensive, sexually explicit or unlawful images, or images of another person without their consent.
• Designs you create with AI design tools are subject to Section 6 and to the rights of Hodler in its underlying technology, templates and garment library.

6. Your Content

You keep ownership of the photos, measurements, sketches and other materials you submit ("Your Content"). You grant Hodler a limited, non-exclusive, royalty-free license to use Your Content solely to operate and provide the services to you — for example, to generate your try-on previews and recommendations. We will not use Your Content for advertising or AI model training without your separate, explicit consent. You may delete Your Content at any time, as described in our AI Try-On & Body Data policy.

You confirm that you have all rights necessary to submit Your Content and that it does not infringe the rights of any third party.

7. Acceptable Use

You agree not to:

• Use the website or services for any unlawful, harmful or fraudulent purpose.
• Attempt to gain unauthorized access to our systems, or interfere with their operation or security.
• Scrape, copy, reverse engineer or extract data or models from Hodler AI.
• Upload viruses, malware or any harmful code.
• Impersonate any person, or misrepresent your affiliation with any person or entity.
• Harass, abuse or harm other users or our team.

8. Intellectual Property

The Hodler name, logo, website design, text, product designs, 3D garments, software and Hodler AI technology are owned by or licensed to Hodler LLC and are protected by intellectual property laws. You may not copy, reproduce, distribute or create derivative works from them without our prior written permission. Some images on this website are used for styling inspiration and remain the property of their respective owners.

9. Third-Party Links

Our website may contain links to third-party websites or services, such as maps or social platforms. We are not responsible for their content, policies or practices, and your use of them is at your own risk.

10. Disclaimers

Our website and services, including Hodler AI, are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the services will be uninterrupted, error-free or completely secure.

11. Limitation of Liability

To the fullest extent permitted by law, Hodler LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website, products or Hodler AI. Our total liability for any claim relating to the services will not exceed the amount you paid to Hodler for the product or service giving rise to the claim. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

12. Indemnification

You agree to defend, indemnify and hold harmless Hodler LLC from any claims, damages or expenses arising from your violation of these Terms, your misuse of the services, or Your Content.

13. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us so we can try to resolve the matter informally.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of our website or services after changes take effect means you accept the revised Terms.
